Participant Media Release
This release explains how Podforge Studios may use media featuring a client, client representative, or other participant. Your service and booking are not conditioned on granting optional promotional permission.
1. Recording authorization
By participating in a scheduled production, you authorize Podforge Studios to record your voice, image, likeness, name, performance, and statements in audio, video, photographs, transcripts, and related production materials (the “Media”) as needed to provide the services connected with the session.
2. Optional unpaid promotional use
If you select “Yes” to unpaid promotional use on a Podforge form, you grant Podforge Studios a non-exclusive, worldwide, royalty-free permission to edit, reproduce, display, publish, and distribute Media featuring you through Podforge’s website, portfolio, social media, email marketing, presentations, and other unpaid promotional channels.
If you select “No,” Podforge will keep your appearance out of its promotional use. Your choice does not reduce the service or deliverables you purchased.
3. Paid advertising is separate
Paid advertisements and sponsored placements require a separate affirmative “Yes.” Permission for unpaid portfolio or promotional use does not automatically include paid advertising.
4. Editing and context
Approved Media may be edited, cropped, captioned, formatted, combined, excerpted, or adapted for different channels. Podforge will not knowingly alter your statements in a materially misleading way or present them as a testimonial or endorsement without separate permission.
5. Identification and tagging
Podforge will identify or tag you or your business only when that preference is separately approved and the relevant account information is provided.
6. Ownership and client deliverables
This release does not change the ownership, delivery, or usage terms stated in your service agreement, package, invoice, or booking terms. Podforge retains its rights in its production work and promotional assets, while you retain any rights expressly granted with your purchased deliverables.
7. Compensation
Unless Podforge agrees otherwise in writing, no additional compensation, royalties, or approval fees are owed for uses you authorize through the media-permission selections.
8. Withdrawal for future use
You may withdraw optional promotional permission for future uses by emailing [email protected]. Media already published, distributed, cached, reposted, printed, scheduled, or incorporated into an existing campaign before Podforge receives and processes the withdrawal does not have to be recalled.
9. Age and authority
You confirm that you are at least 18 years old and are accepting these terms for your own appearance. A parent or legal guardian must complete a separate written authorization for a minor. A representative signing for an organization confirms authority to provide the information submitted, but does not replace each identifiable adult participant’s personal authorization.
10. Governing law and complete agreement
This release is governed by South Carolina law. The media choices recorded with your submitted form, this page, and any signed project agreement together state the applicable media permissions. If a signed project agreement directly conflicts with this page, the signed project agreement controls.
